In accordance with California Civil Code Section 4360(a), the Aviara Master Association (AMA) Board of Directors hereby provides you with formal notice of adoption of the following operating rule change to the Community Rules and Regulations pertaining to “Open House Signs”. Notice of the proposed rule change was issued to the membership on May 20, 2026, for the required twenty-eight (28) comment period. The Board reviewed homeowner comments and resolved to adopt the proposed rule change as final at the Board meeting held on June 18, 2026.
Open House
Signage Rules:
1.Maximum Sign Limit: A maximum
of six (6) open house signs per
property is permitted within the Aviara Community.
2.Restricted Monument Areas: No signs are permitted at the
monuments located at Aviara
Parkway and Poinsettia. These areas are marked as private
property with “No Trespassing” signage. Any violation may result in trespass penalties.
3.Approved Placement Areas:
Open house signs may be placed in appropriate
common areas, including locations adjacent to existing Aviara Master Association flower and plant beds,
provided placement does not cause damage.
4.Required Sign Type:
Only stake-type sign frames designed
to minimize ground disruption are permitted. Sign installation must not damage landscaping, irrigation systems, or plant
beds.
5.Liability for Damage:
The homeowner is responsible for
any damage caused by their agent or representatives. Any repair costs incurred
by the Association will be charged
back to the homeowner.
6.Prohibited Attachments: Inflatable balloons or similar attachments affixed
to signs are strictly prohibited.
7.Time Restrictions: Signs may
only be placed on the day of the
scheduled open house. All signage must be removed by dusk on the same
day. Overnight placement is not
permitted.
